1. Acceptance of Terms
By engaging Sparklusion Events ("Company") for photography, videography, or event planning services, you ("Client") agree to be bound by these Terms & Conditions. These terms constitute a legally binding agreement.
2. Booking & Confirmation
2.1 Booking Process: All bookings require a signed contract and advance payment as specified in the payment schedule.
2.2 Date Reservation: Your event date is reserved only upon receipt of the advance payment and signed contract.
2.3 Contract Binding: Once the contract is signed and advance payment received, both parties are legally bound to fulfill obligations.
3. Payment Terms
3.1 Payment Schedule:
- Wedding Photography (₹69,999+): 50% advance at booking, 30% two weeks before event, 20% on event day
- Event Photography (₹4,999+): 100% advance payment required
- Wedding Planning: As per custom agreement
3.2 Payment Methods: Bank transfer, UPI, credit/debit cards, or cash. GST invoices provided for all transactions.
3.3 Late Payments: Late payments attract 2% interest per month. Company reserves the right to withhold deliverables until full payment is received.
4. Cancellation & Refund Policy
4.1 NO REFUND POLICY: All payments made to Sparklusion Events are 100% NON-REFUNDABLE under any circumstances.
4.2 Client Cancellation: If Client cancels for any reason (including force majeure, illness, family emergency, venue issues, etc.), all payments made are forfeited.
4.3 Date Rescheduling: Client may reschedule ONCE subject to availability, with ₹10,000 rescheduling fee. Second rescheduling not permitted; all payments forfeited.
4.4 Company Cancellation: If Company cancels (extremely rare), full refund will be provided within 30 days, with no additional compensation.
5. Service Delivery
5.1 Photography Delivery: Edited photos delivered within 15-20 working days via online gallery. Physical copies not included unless specified in contract.
5.2 Videography Delivery: Cinematic films delivered within 30-45 working days via online link.
5.3 Albums & Prints: If ordered, delivered within 60-90 days from photo delivery date.
5.4 Delivery Delays: Company not liable for delivery delays due to technical issues, natural disasters, or circumstances beyond control. No compensation for delays.
6. Intellectual Property & Usage Rights
6.1 Copyright: All photographs, videos, and creative content remain the intellectual property of Sparklusion Events. Company retains full copyright.
6.2 Client Usage: Client receives personal usage rights only. Commercial use, reproduction for sale, or unauthorized distribution strictly prohibited.
6.3 Company Portfolio: Company reserves the right to use images/videos for marketing, portfolio, social media, awards, and promotional purposes without additional consent.
6.4 Watermarks: Company may add watermarks to shared content. Removal of watermarks prohibited.
7. Event Day Responsibilities
7.1 Access: Client ensures Company team has full access to all event areas, including getting-ready locations, ceremony venues, and reception halls.
7.2 Timing: Delays in event schedule beyond Company's control are Client's responsibility. Company not liable for missed moments due to schedule changes.
7.3 Cooperation: Client and family agree to cooperate with photography/videography requirements, including posing for formal shots and group photos.
7.4 Third-Party Interference: Company not responsible for interference by guests, family members, or other vendors affecting work quality.
8. Limitation of Liability
8.1 Maximum Liability: Company's total liability shall not exceed the total contract value paid by Client.
8.2 Equipment Failure: While Company carries backup equipment, total equipment failure due to unforeseen circumstances (extremely rare) limits liability to contract value only.
8.3 Lost Footage: In the rare event of data loss despite backup protocols, Company liability limited to full refund only. No additional damages payable.
8.4 Force Majeure: Company not liable for non-performance due to natural disasters, pandemics, government restrictions, riots, accidents, or any force majeure events.
9. Client Obligations
9.1 Information: Client must provide accurate event details, timings, locations, and contact information.
9.2 Permissions: Client responsible for obtaining all venue permissions for photography/videography.
9.3 Vendor Meals: Client provides meals for Company team during events exceeding 6 hours.
9.4 Accommodation: For destination weddings, Client provides accommodation for Company team or reimburses actual costs.
10. Content Selection & Editing
10.1 Editorial Control: Company has sole discretion over final content selection, editing style, and color grading.
10.2 Minor Edits: Company provides minor touch-ups. Major photo manipulation or extensive editing not included.
10.3 Raw Footage: Raw, unedited photos/videos NOT provided under any circumstances.
11. Weather & Outdoor Shoots
11.1 Weather Dependency: Outdoor shoots subject to weather. Company not responsible for weather conditions.
11.2 Backup Plans: Client responsible for indoor backup venues for outdoor events.
11.3 No Refunds: Poor weather does not entitle Client to refunds or discounts.
12. Disputes & Jurisdiction
12.1 Governing Law: These terms governed by laws of India.
12.2 Jurisdiction: All disputes subject to exclusive jurisdiction of courts in Noida, Uttar Pradesh.
12.3 Arbitration: Disputes resolved through arbitration before litigation, as per Arbitration and Conciliation Act, 1996.
13. Modifications
Company reserves the right to modify these terms at any time. Updated terms posted on website. Continued use of services constitutes acceptance.
